my life is ruined
The story
yesterday at 9:17, a process server walked into the office where i handle customer invoices and asked for me by my full name. the court notice was folded inside a thick envelope, but everyone near reception watched him hand it over like i was being arrested. my brother owes $11,480 in unpaid rent, fees, and court costs, and the landlord is collecting from me because i co-signed his apartment. i read the balance beside the copy machine and thought, very calmly, my life is ruined. a week before the rent stopped, he sent me a photo of his new TV and joked that adulthood was finally working out for him. his phone now goes straight to voicemail, his social accounts are gone, and he left without warning or a forwarding address. i had signed the lease after he promised, "you will never have to pay a cent." apparently that promise was not an enforceable addendum 😐
the notice says the creditor has requested wage garnishment, which means payroll may have to divert part of every paycheck before the money reaches my bank account. our HR manager closed her door and explained withholding orders in the same gentle voice she uses when someone loses dental coverage. my own lease renewal is sitting unsigned because the property manager asked for updated income verification, and the garnishment could make me fail their rent-to-income requirement. the property manager already emailed, "we need the documents promptly," which felt lovely while a creditor was preparing to take money directly from my wages. i keep calculating groceries against rent and wondering which exact expense is supposed to become imaginary. after covering my brother's security deposit when he moved in, my savings never fully recovered. apparently the morally correct response is to become homeless quietly and avoid embarrassing him;
my mother knows he is staying with somebody in Phoenix because my cousin let the city slip during a family call. she begged me not to give that information to the landlord's attorney because, in her words, "he is already scared and exposing him would be selfish." my aunt agreed and said a decent sister would protect him until he was ready to explain. when i asked who was protecting my paycheck or my apartment, the call became extremely quiet, then my mother accused me of making money more important than family. apparently his unpaid apartment is a private family matter, while the court papers delivered beside my coworkers are my personal character test 🙃. my brother has not contacted me, apologized, or even asked whether the garnishment will leave me enough for my own rent. i am being treated like the aggressor because i want to give the creditor an address where they might actually find the tenant named on the lease. the sarcasm is keeping me functional, but barely.
a legal aid clerk explained that the lease has joint and several liability, so the landlord can pursue me for the full balance even though i never lived in that apartment. the default judgment also means ignoring the notice will not make the withholding order disappear, which was useful information and also a fresh nightmare. filing against my brother later may be possible, but i would need somewhere to serve him and evidence that he has income or assets worth pursuing. if i tell the attorney where he is, my family may stop speaking to me, and the debt could still remain attached to my wages. i understand that i signed the document, and i am not pretending the signature belongs to somebody else. part of me still cannot accept that helping him qualify for an apartment turned into a court order threatening mine. please be direct, because everyone related to me has decided his disappearance is less offensive than my objection to paying for it. should i expose where my brother is hiding, even if my family calls me selfish, or quietly lose my apartment now that my life is ruined?
